Terms of Service

1. Acceptance

By using GitInsight you agree to these terms. Organisation representatives confirm they have authority to bind their organisation.

2. Description of Service

GitInsight is an engineering analytics platform available as a cloud SaaS and self-hosted product, providing DORA metrics, PR analytics, AI insights, and compliance tooling.

3. Free Trial

A 14-day free trial includes all Enterprise features. No credit card is required to start. After the trial ends there is a 7-day grace period (read-only access), after which the account is suspended until a subscription is activated.

4. Subscriptions and Payment

Subscriptions are billed per seat per month in EUR (excluding VAT) via Stripe and auto-renew unless cancelled.

5. Cancellation and Refunds

You may cancel at any time via the billing portal or by emailing support@ekwix.com. No pro-rata refunds are issued for the current billing period.

6. Acceptable Use

You must not: reverse-engineer or resell the software, introduce malware or conduct DoS attacks, or use the service for unlawful data processing.

7. Data Ownership

You own your data. You grant ekwix a limited licence to process it solely to deliver the service. For self-hosted installations your data never leaves your infrastructure.

8. Intellectual Property

ekwix owns all software, branding, and documentation. These terms do not transfer any intellectual property rights to you.

9. Service Availability

We target 99.5% monthly uptime for the cloud service and provide 24 hours' notice for planned maintenance windows.

10. Limitation of Liability

Our total liability is capped at three months' subscription fees. We are not liable for indirect or consequential damages.

11. Changes

We will provide 14 days' email notice before material changes. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by Netherlands law. Disputes are subject to the exclusive jurisdiction of the courts of Amsterdam.
